Terms of service of the website available in the testto.com domain.
This document is an English translation of the Polish original, provided for convenience. In case of any discrepancy, the Polish version prevails.
1. Definitions
- Website Operator – Exelo ITS sp. z o.o. with its registered office in Bydgoszcz (85-092) at ul. Ogińskiego 2, entered in the register of entrepreneurs kept by the District Court in Bydgoszcz under KRS number: 0000739862; NIP (tax ID): 5272857846.
- Privacy Policy – the privacy and cookies policy containing provisions on the processing of personal data by the Website Operator.
- Terms – these terms of service of the Website available in the testto.com Internet domain. This document also constitutes the terms of providing services by electronic means referred to in Article 8(1)(1) of the Polish Act of 18 July 2002 on providing services by electronic means.
- Website – the online platform operated by the Website Operator, available in the testto.com domain.
- Services – services provided or made available by the Website Operator through the Website, in particular giving the User access to the content of the Website.
- User – a natural person, a legal person or an entity without legal personality on which the law confers legal capacity, using the content or services provided through the Website.
2. Preliminary provisions
These Terms set out the rules for the use of the Website by Users. The User is obliged to read the Terms and accept their provisions before starting to use the Website.
Within the Website, the Website Operator makes the Website's functionalities available. The main functionality of the Website is access to the content placed on the Website by the Operator and the use of the contact form.
By using the Website, the User agrees to be bound by these Terms. If the User does not agree with the provisions of these Terms, using the functionalities of the Website is not permitted.
The use of the Website and the Services available in it is free of charge.
Unless stated otherwise, whenever the Website Operator's e-mail address is mentioned, it is the following e-mail address: kontakt@testto.com
3. Services
Within the Website, the User is given access to the content available on the Website, placed there by the Website Operator.
The User may use the Website to contact the Website Operator via the contact form or a chatbot tool.
To use the contact form or chatbot, it is necessary to provide the data required by the Website in the dedicated form — for the contact form this is an e-mail address and acceptance of the Terms and the Privacy Policy, and for the chatbot a first name and an e-mail address.
The User is obliged to provide true data. Providing untrue or incorrect data may make it impossible to contact the User in response to the submitted enquiry.
The use of the Website, including the Services, is free of charge.
4. Duration of the Agreement
The agreement with the User is concluded for the time needed to handle the enquiry submitted via the dedicated contact form.
The User is entitled to terminate the Agreement at any time.
5. Technical requirements
Minimum technical requirements for using the Website:
- a device with Internet access and an up-to-date operating system;
- an installed, correctly configured and up-to-date version of a web browser;
- for the contact form — an active e-mail account.
6. Intellectual property
The Website is protected by copyright. This protection covers the content of the Website, the tools making up its functionalities and other works qualified by copyright law as protected works. The Website Operator has the right to use them under a separate agreement and they are reserved.
Any processing of data and other information available on the Website for the purpose of making it available to third parties within other websites, as well as outside the Internet, is prohibited.
Any publication of data taken from the Website should include a precise reference to the Website. The Website Operator points out that, regardless of meeting the condition set out in the preceding sentence, it is prohibited to publish, for commercial purposes, content owned by the Website Operator under copyright law without the prior written consent of the Website Operator.
It is prohibited to create any tools or databases containing data concerning the Website Operator's business.
7. Personal data protection
The Website operates in accordance with applicable personal data protection law. Detailed information, scope, rules and privacy conditions are available on the Privacy policy page.
8. Liability of the Website Operator
The Website Operator makes reasonable efforts to ensure that the content of the Website is up to date, accurate and continuously available.
Although the Website Operator makes every effort to ensure that the functionalities available within the Website are continuously available and work correctly, it is not liable for any consequences arising from their incorrect operation or unavailability at any time, including consequences arising from reliance on those functionalities.
The Website Operator is not liable if, for any reason, the Website is unavailable at any time or for any period.
The Website Operator makes every effort to keep the Website free of malicious software; however, the Website Operator is not liable for the effects of using the Website on the User's computer system or mobile system, including technical infrastructure and data.
The Website Operator is not liable for the proper operation of the operators providing connectivity to the Website, either on the side of the Website Operator or on the side of the persons using the Website.
The Website Operator is not liable for the legal, financial or any other consequences of the User's use of the information contained on the Website. The Website Operator is not liable for any damage or losses incurred by the User or third parties connected in any way with the use of that information, including for the purpose of making a decision in an individual case. The User uses the Website and the functionalities available within it at their own risk and is obliged to verify them before use.
The Website may contain links to websites belonging to third parties. The Website Operator is not liable for the availability of the content of those websites, its quality or accuracy, or the possible consequences of following a link.
If the User becomes aware of an error in the operation of the Website or an error in the data available through the Website, the User is obliged to inform the Website Operator of this fact, and the Operator will make efforts to remove the faulty operation or incorrect data.
9. Enquiries and complaints
Enquiries, requests, complaints and comments from Users regarding the operation of the Website and the services provided through it should be sent to the Website Operator's e-mail address kontakt@testto.com. A complaint should contain at least an e-mail address and a precise description of the circumstances and irregularities that are the reason for the complaint. If the data or information provided in the complaint does not allow the Website Operator to examine it, the Website Operator will ask the User to clarify any doubts or provide additional information by e-mail, if this is necessary for the Website Operator to examine the complaint, indicating precisely such doubts or required information. If, despite this, the User does not send the required data, the Website Operator may leave the complaint unexamined.
A complaint should be submitted within 30 days of the occurrence of the event giving rise to it. Complaints will not be examined after that 30-day period.
Complaints will be examined within 14 days of receipt. The response to a complaint is sent electronically to the address provided in the complaint.
By submitting a complaint, the User consents to the processing of personal data to the extent of the e-mail address from which the complaint was sent.
10. Final provisions
The Website Operator has the right to amend the provisions of the Terms by publishing the amendments on the Website and delivering such information to the User at the provided e-mail address, if it has one. Amendments come into force on the date indicated by the Website Operator, unless applicable law provides otherwise. The User should read the amendments introduced by the Website Operator.
A User who does not agree to the amendments to the Terms may not use the Account after the expiry of the period referred to above. Continued use of the Website by the User after the amendments to the Terms come into force constitutes acceptance of those amendments.
The Website Operator reserves the right to a binding interpretation of the content of the Terms.
